The Mykolaiv District Administrative Court ruled that the entry of information regarding violations of military registration rules into the register of persons subject to military service was unlawful and ordered the territorial recruitment center to remove this data.
As stated in the case file, the man learned of his status as a violator of military registration rules and the corresponding “wanted” flag in the “Reserve+” app. The reason given was his failure to appear at the Territorial Recruitment Center and the Military Registration and Enlistment Office in response to a summons.
The plaintiff claimed that he had not received the summons and had not been properly notified of the need to appear at the Territorial Recruitment Center. He also stated that he had left for Germany before the start of the full-scale war and has been residing there permanently.
In response to a request from the plaintiff’s attorney, the Territorial Recruitment Center stated that it had issued and sent the man a summons for June 2, 2025, to verify his information. However, in court, no evidence was presented to show that the summons had been mailed or any other documents confirming that the plaintiff had been properly notified.
The court noted that the TCC has the authority to enter information into the registry regarding violations of military registration rules, particularly in cases of failure to appear in response to a summons, even if the mailed notice was returned undelivered. At the same time, in this case, the defendant failed to prove that the man had actually been summoned to the TCC.
Since there was no evidence of a proper summons, the court concluded that the information regarding the violation of military registration rules had been entered without grounds. The Military Registration and Enlistment Office did not file a response to the complaint and did not object to the claims made.
The court fully granted the claim: it found the TCC’s actions to be unlawful and ordered the removal of the relevant information from the Unified State Register of Conscripts, Persons Subject to Military Service, and Reservists. The court also ordered that 1,331 hryvnias and 50 kopecks in court costs be recovered from the defendant’s budgetary allocations and paid to the plaintiff.
