Police captain convicted in Mykolaiv for fighting during a call

In Mykolaiv, a court sentenced a police captain and an official of the Odesa City Council. He exceeded his authority during a call and lost his rank.
This is evidenced by the verdict of the Arbuzynskyi District Court of Mykolaiv Oblast.
According to the investigation, the acting head of the criminal police sector of the Voznesensk District Department No. 3 exceeded his official authority when called. In addition to working in the Mykolaiv police, the man also works as the head of the monitoring department of the Peresypskyi district administration of the Odesa City Council.
The incident, which became the basis for the criminal case, occurred on October 20, 2022, around 23:30 in the entrance of a multi-storey building on Tsvitotnyi Boulevard. Tsvitchnyi Boulevard, where a conflict occurred between the fourth and fifth floors. According to the investigation, the police captain, dissatisfied with the behavior of the local resident, used physical force - he punched the man in the stomach and grabbed him by the neck, who, according to the investigation, did not commit any illegal actions.
The court examined in detail the circumstances of the incident and the testimony of witnesses. The defendant claimed that he had arrived at the scene that evening at the call of the police chief. At the time of the conflict, the victim was intoxicated and behaved aggressively, insulting the police officers, pushing them and filming them on his phone. According to the accused, he was acting as a driver for the head of the police department and did not harm the victim.
The victim, according to his version, was in his apartment that evening, where he had a disassembled Kalashnikov rifle as a member of a voluntary group. The conflict arose because of neighbors who informed the police about alleged threats with weapons.
The court also examined numerous testimonies of other participants in the event - members of the investigative team, patrol officers and doctors. The witnesses confirmed the fact of the conflict, but differed in the details of the direct use of force.
Ultimately, the court found the defendant guilty of abuse of power under Part 2 of Article 365 of the Criminal Code of Ukraine and sentenced him to three years in prison with disqualification to hold positions in the National Police for three years. At the same time, pursuant to Art. 75 of the Criminal Code of Ukraine, the accused was released from serving the main sentence with probation, setting a probationary period of one year and six months. In addition, he was assigned the duties provided for by law and deprived of his special rank of "police captain".
Recently, pro-Russian telegram channels and websites began spreading reports of an alleged mass murder of TCC employees in Mykolaiv. In fact, this is another Russian fake - no such events have taken place. The fictitious story claims that a resident of Mykolaiv region "shot seven TCC employees", "defended his own house for sixteen hours" and "died during the assault".
