New mobilization rules from the government: who can lose the deferral

The Cabinet of Ministers of Ukraine has amended the procedure for reserving housing for persons liable for military service during mobilization and martial law.
This was reported on the website of the government portal.
According to the decision, deferments from service are extended until February 28, 2025, but their term may be reduced in case of expiration, loss of the status of an enterprise critical to the economy or defense, termination of employment or change of position of the employee. The deferral may be canceled by a decision of the Ministry of Economy, after which the relevant extract from the order must be returned to the military registration and enlistment office within five days.
Among the key innovations is the integration of state registers to automate the booking process. This will make it easier to keep track of data on employees, companies and their status. In addition, the government has extended the status of critical enterprises until the end of 2024 for those whose term was set to expire in November.
The updates also provide for the involvement of the Pension Fund in the transfer of information on changes in the labor relations of employees who are on reservation. The decision will come into force on December 1, 2024, except for certain clauses that are effective from the date of publication. The government's changes are aimed at improving the mobilization mechanism and increasing the efficiency of human resources management during the war.
The Resolution introduces the main provisions of the changes for business (critical enterprises):
- deferrals from conscription granted by the Ministry of Economy or throughDiia are valid until the end of the term, but no longer than until 28.02.2025;
- decisions on the criticality of enterprises, which expire by 11/30/2024, are extended until 12/31/2024;
- reservations for persons liable for military service are made only through Diia;
- by a separate decision of the Minister of Defense, more than 50% of persons liable for military service can be booked;
- the total number of persons liable for military service offered for reservation does not include women liable for military service;
- to be booked, the salary of persons liable for military service for the last 3 months of the last reporting quarter must be at least the minimum wage multiplied by 2.5;
- in donor projects, up to 50% of employees who are directly involved in the implementation of tasks can be booked;
- companies submit data on employees to the Pension Fund no later than the day after changes in labor relations;
- the reservation is canceled if the employee's salary is less than a certain level;
- cancellation can be made through Diia;
- the criticality of the enterprise will be agreed with the Ministry of Economy and the Ministry of Defense.
The mandatory criteria for recognizing an enterprise as critical are:
- no tax and unified social contribution arrears;
- the average salary of employees for the last quarter is not less than the minimum wage multiplied by a factor of 2.5.
