The owner of a shopping center in Mykolaiv was ordered to pay 4 million in rent arrears for municipal land

A court ordered the owner of one of Mykolaiv’s shopping centers to repay a land lease debt to the city council.
This was reported by the press office of the Mykolaiv Regional Prosecutor’s Office.
According to the office, the Mykolaiv City District Prosecutor’s Office determined that the owner of the shopping and entertainment center had failed to pay rent for the use of a municipally owned plot of land covering more than one hectare, resulting in a loss of 4.4 million hryvnias to the city budget.
The prosecutor’s office noted that, given the city council’s inaction, the Mykolaiv City District Prosecutor’s Office filed a lawsuit against the debtor to enforce collection of the specified debt. During the proceedings, the defendant voluntarily paid 450,000 hryvnias to the city budget, and the remaining debt was collected by the Commercial Court of Mykolaiv Oblast. Once the court’s decision becomes final, measures will be taken to enforce it in full.
Previously, the Mykolaiv City District Prosecutor’s Office filed a lawsuit seeking to overturn the city council’s decision to lease a 7,643-square-meter plot of land for theconstruction of a gas station. The disputed plot is a recreational green space for public use. It is located at the intersection of Bogoyavlensky Avenue and Shura Kober Street. It was first leased for the construction of a sports and health center in 2005. By 2015,the lessee had notbuilt anything on the site. Given the lessee’s failure to comply with the terms of the agreement, as well as public outrage over the removal of greenery, the city council refused to renew the agreement. The tenant was ordered to return the land and demolish the unfinished structure (5% complete). In 2023, courts at two levels confirmed the legality of this decision.
