The municipal enterprise “Odessa International Airport” successfully recovered more than one and a half million hryvnias in debt from a Uzhhorod-based company through the courts. Lawyers proved the existence of the debt under agreements dating back to 2013, the originals of which were destroyed during rocket and drone attacks on Odesa.
This is stated in the ruling of the Commercial Court of Zakarpattia Oblast.
The judges took into account that the loss of the original documents occurred due to force majeure circumstances related to the war. At the same time, the airport provided other compelling documents: preserved supplementary agreements, reconciliation statements, accounting statements, and official correspondence.
Furthermore, the Uzhhorod-based company had previously confirmed the existence of the debt in writing, although it refused to pay due to a lack of funds and citing martial law. The court ruled that the combination of these documents and the debtor’s written admission constitutes sufficient proof of the obligations even in the absence of the original agreements themselves.

According to the case file, seven contracts were signed in 2013 between the municipal enterprise and the private company “SPMK-7,” under which the partners from Uzhhorod incurred a debt of 1,527,869 hryvnias. During enemy attacks on the infrastructure of the Odesa airport, the original contracts were destroyed by fire.
