In Odesa, a court terminates a land lease agreement worth 167 million

The court upheld the claim of the Khadzhybey District Prosecutor's Office of Odesa and terminated the agreement with the unscrupulous land tenant.

This was reported by the press service of the Odesa Regional Prosecutor's Office.

The company was ordered to return a land plot of more than 50,000 square meters near Savytskyi Park. The recreational land was allocated to a limited liability company for the construction and maintenance of physical culture and sports facilities.

Prosecutors found that the company obtained the right to lease the land plot to complete the construction and further operation of the unfinished sports complex. However, without completing the construction work, the company used the land for its own needs. The market value of the land plot is over UAH 167 million.

Last year, the court returned to state ownership the building of the sports complex that was supposed to operate on this land, but its construction was not completed, contrary to the terms of privatization. In 2002, the State Property Fund of Ukraine and the defendant entered into a contract for the sale of an asset under construction. The terms of the agreement provided for the completion of the works by 2014. However, the owner did not take any action to complete or improve the territory. The complex was gradually deteriorating, and its intended purpose as a sports facility was effectively ignored. In view of the gross violation of the contract, the prosecutor's office initiated a lawsuit in the interests of the state.

The Commercial Court of Odesa Region upheld the prosecutor's claims. The appellate instance confirmed the legality of the decision, and the Supreme Court closed the appeal proceedings. The decision came into force. Pursuant to the court decision, in April 2025, the parties signed an acceptance certificate, and the sports complex was finally returned to state ownership.
