The Mykolaiv District Administrative Court partially satisfied the claim of a serviceman against one of the military units of the National Guard of Ukraine regarding the recalculation of financial support and payment of additional remuneration.
This became known to Intent from the decision of the Mykolaiv District Administrative Court, which recognized the actions of the military unit as unlawful for not accruing part of the payments and ordered a recalculation.
According to the court's decision, the serviceman served from April 2022 to February 2025 and claimed that he was incorrectly paid his official salary and salary according to his military rank. He also claimed that he did not receive the full amount of additional remuneration provided for by Cabinet of Ministers Resolution No. 168, and demanded indexation and compensation for the property he did not receive.
The court concluded that the military unit had to calculate the financial support based on the subsistence minimum established as of January 1 of the relevant year, and not on the fixed indicators of 2018. In addition, it was established that the serviceman was not paid additional combat remuneration for certain periods of service in Kherson region.
At the same time, the court dismissed the claims for the payment of indexation of financial support and compensation for unreceived material property.
By the court's decision, the military unit is obliged to recalculate and pay the shortfall in cash and additional remuneration for the period from April 30, 2022 to May 31, 2023.
Recently, the Mykolaiv District Administrative Court dismissed a claim for exclusion from the military register of a citizen who had previously served a sentence for a serious crime.
Earlier, the Korabelnyi District Court of Mykolaiv canceled a fine of 17 thousand hryvnias imposed by the territorial recruitment center on a father of many children for allegedly violating the rules of military registration.
