In Mykolaiv, a convict was not allowed to withdraw from military registration

The Mykolaiv District Administrative Court dismissed a claim for exclusion from the military register of a citizen who had previously served a sentence for a serious crime.
As Intent found out in the court decision of April 27, 2026, the plaintiff demanded to declare the inaction of the Military Registration and Enlistment Committee unlawful and to oblige it to enter information about his exclusion from the register into the Unified State Register of Conscripts, Persons Liable for Military Service and Reservists.
The lawsuit was based on the fact that the man had previously been excluded from military registration on the basis of paragraph 5 of Article 37 of the Law of Ukraine On Military Duty and Military Service, in the version that was in force until 2024. According to this provision, persons sentenced to imprisonment for grave or especially grave crimes were excluded from the register.
The court found that the current legislation no longer provides for exclusion from the military register due to a criminal record. On the contrary, such persons can now be registered and even called up for military service during mobilization, with the exception of certain categories of crimes.
The decision states that the changes in the legislation are aimed at expanding the mobilization resource under martial law and do not have retroactive effect, but apply to current legal relations.
Therefore, the court concluded that the refusal to amend the register was lawful and dismissed the claim in its entirety.
As a reminder, the Korabelnyi District Court of Mykolaiv canceled a fine of 17 thousand hryvnias imposed by the territorial recruitment center on a father of many children for allegedly violating the rules of military registration.

The number of unpaid fines for violations of military registration in Ukraine is growing, and more than 9,000 proceedings have been opened since the beginning of the year. Mykolaiv region ranked second among the southern regions in terms of fines.
Earlier, a Mykolaiv court handed down a two-year probation to the administrator of a Telegram channel that disclosed the routes of movement of employees of the territorial center for recruitment and social support. The man, who had more than 380 subscribers, was obstructing the mobilization.
