High Council of Justice closes disciplinary proceedings against judge from Odesa

The High Council of Justice has closed disciplinary proceedings against judge of the Primorskyi Court of Odesa Tetyana Fedchyshena.
This was reported by the HCJ press service.
The proceedings against the judge were initiated by the Third Disciplinary Chamber of the HCJ due to a complaint about what the complainant believed to be an unlawful denial of access to justice during the case. The complainant stated that the judge left without consideration the application for replacement of the party in the enforcement proceedings, arguing that the applicant's lawyer did not have sufficient authority to file the relevant application.
The Third Disciplinary Chamber of the HCJ found that the judge left the application for replacement of the party in the enforcement proceedings without consideration due to the fact that the lawyer was a military officer. The judge believed that military service is incompatible with the practice of law under the current legislation, and therefore, from the moment of military service, the lawyer automatically lost his powers of representation.
In its turn, the HCJ recognized that such actions of the judge led to the restriction of the right to access to justice. Moreover, there is no information about the suspension of the right to practice law of the applicant's lawyer in the Unified Register of Advocates of Ukraine. Therefore, the judge was punished with a warning.
Earlier, the High Council of Justice appealed to the Prosecutor General's Office for information on the course of the criminal investigation, which was registered at the request of Judge Kostiantyn Ionidi of the Prymorskyi District Court of Odesa. Kostiantyn Ionidi stated that on January 23, he received an indictment with a plea agreement against a local taxi driver accused of influence peddling. The next day, the court received a letter stating that the judge was to receive a bribe for approving the agreement.
