Court arrests building of Odesa dolphinarium

The Economic Court of Odesa Region has imposed an arrest by restricting the right of disposal on the building of the Odesa City Dolphinarium with an aquarium and a rehabilitation and health center for dolphin therapy with a total area of 21,877 square meters.
Thus, the court partially satisfied the claim of the Deputy Head of the Prymorskyi District Prosecutor's Office of Odesa.
The prosecutor's office appealed to the court to recover UAH 11 million 991 thousand in arrears from the owners of the dolphinarium, Nerum Limited Liability Company and Neptune White Sphere Limited Liability Company, in favor of the Odesa City Council.
In support of the claim, the prosecutors pointed to the need for the defendants, as construction customers, to pay the share participation in connection with the construction of the facility, which began in May 2018 and was commissioned in October 2022.
Why partially
In addition to seizing the real estate, the prosecutor also requested the seizure of Nerum LLC and Neptune Bila Sfera LLC's funds in hryvnia and foreign currency held on open accounts in banking or other financial institutions, including those of other countries, as well as funds on accounts to be opened after the ruling on securing the claim and belonging to these companies, within the same amount of almost UAH 12 million. However, the court did not satisfy this part of the claim.
Entrepreneurs disagree
The defendants, in turn, objected to the prosecutor's applications, stating that the filing of applications for interim relief was not aimed at ensuring the interests of the territorial community, but at paralyzing the defendants' business activities.
Also, in a comment to Dumskaya, a representative of Neruma LLC said that on January 1, 2021, the provisions of the Law "On Amendments to Certain Legislative Acts of Ukraine on Stimulating Investment Activity" came into force, which completely abolished equity participation. The firm then asked the mayor's office whether it had to pay and received a response that there were no legal grounds for this.
According to the YouControl service, Nerum LLC was registered in 2003. Currently, one of the co-owners of the company is Raisa Kislovska, the mother of Andrii Kislovskyi, a member of the Odesa City Council. She and another co-owner of this company, Serhii Keliushok, are the ultimate beneficiaries of Neptun Bila Sfera LLC, founded in 2008.
