Mykolaiv Court Orders Management Company to Compensate Flood Victim 113K

A Mykolaiv court ordered a management company to pay compensation to an apartment owner for flooding due to improper maintenance of the building. The company must reimburse more than UAH 113 thousand, including material damages, non-pecuniary damage and legal fees.

This was reported by the press service of the Central District Court of Mykolaiv.

The Mykolaiv court upheld the claim of an apartment owner against the management company Z. Housing and Communal Services LLC due to improper maintenance of the apartment building, which led to flooding of his home.

The plaintiff argued that due to the company's negligence, the roof was damaged, and precipitation began to penetrate the apartment. The cost of restoring the apartment was estimated at UAH 80,800. In addition, the man suffered non-pecuniary damage due to the stress caused by the destruction of his property and the company's lack of response.

Representatives of the company tried to deny the claims, stating that the damage was caused by shelling, not their inaction. However, the court, having analyzed the evidence provided, found that the company had not properly performed its duties.

According to the court's decision, Z. Housing Office LLC must pay the plaintiff compensation: UAH 80,800 for material damages, UAH 8,000 for non-pecuniary damage, and more than UAH 25,000 to cover court costs.

Last year, a Mykolaiv court ordered the condominium to pay compensation for flooding the apartment with sewage. The serviceman filed a lawsuit and won the case.

The plaintiff explained that since November 2022, his apartment had been flooded seven times due to clogged sewer pipes in the basement. In his opinion, the condominium association was responsible for this, as it failed to ensure the proper condition of the system. The court ruled to recover UAH 143,573 from the condominium as compensation for material damage, as well as the costs of the expert examination and court fees.

For residents of apartment buildings, such situations are not just an unpleasant incident, but a constant risk. The reason may be not only the negligence or irresponsibility of neighbors, but also the improper maintenance of utilities.

In developed countries, such problems are much easier to solve: usually both the housing itself and the liability of property owners are insured, so the issue is settled through an insurance company.
