Mykolaiv Executive Committee Receives Warning from the Antimonopoly Committee

Antimonopoly officials issued a recommendation to the executive committee of Mykolaiv City Council to comply with the legislation on protection of economic competition. It concerns passenger transportation on public bus routes.

This was reported by the press service of the Southern Department of the Antimonopoly Committee.

It was established that the Executive Committee of Mykolaiv City Council did not hold a tender to determine carriers on certain bus routes operating within the Mykolaiv territorial community.

This, in turn, created conditions under which transportation is carried out by business entities that have received the right to operate on these routes without a competitive procedure, which violates the norms of current legislation.

The Administrative Board of the AMCU's Southern MTV issued recommendations to the Executive Committee of Mykolaiv City Council aimed at eliminating inaction that may restrict competition in the passenger transportation market. This is a violation under paragraph 3 of Article 50 and part one of Article 15 of the Law of Ukraine "On Protection of Economic Competition", in particular, anticompetitive actions of a local government body.

The Mykolaiv City Council is obliged to inform the Office of the measures taken within 90 days of receiving the recommendations.

Recently, a municipal enterprise in Mykolaiv received a tender for almost half a billion hryvnias to provide transportation services to city residents. The funds were allocated by the city executive committee.

The agreement to provide passenger transportation, including trams and trolleybuses, was signed with Mykolaivelectrotrans. The procurement was made without open bidding, arguing that the company is the only provider of electric transport services in the city.

In December last year, the Antimonopoly Committee also recorded violations in the field of passenger transportation in Mykolaiv region. In particular, it was found that the Arbuzyn village council did not organize a tender to determine the carrier for a bus route within the community.
