Serviceman's insurance period: how it is calculated and under what conditions

In Ukraine, according to the law, military personnel have special guarantees when calculating their insurance period and retirement. Lawyers from the free legal aid (FLA) system told us more about the calculation of service record.

What length of service is calculated on preferential terms

According to the lawyers of the FLA, when granting pensions for military service, the length of service on preferential terms includes: service in the army during hostilities, including during the performance of international duty and stay in guerrilla units and formations.

It should be noted that mobilized and contract servicemen continue to accrue work experience, including in the combat zone, in accordance with Article 8 of the Law of Ukraine "On Social and Legal Protection of Servicemen and Members of Their Families". At the same time, the period of military service during a special period declared in accordance with the Law of Ukraine "On Defense of Ukraine", including during martial law, is included not only in the length of service, but also in the length of service.

Granting an early pension for combatants

Lawyers of the FLA system note that servicemen who participated in combat operations, the ATO and measures to repel Russian aggression are entitled to an early pension. These are men who have reached the age of 55 with 25 years of insurance coverage and women who have reached the age of 50 with 20 years of insurance coverage.

The full list of persons entitled to early retirement can be found in Article 115 of the Law of Ukraine "On Compulsory State Pension Insurance".

What documents are required to apply for a combatant pension?

The amount of a combatant's pension depends on the length of the insurance period and the earnings from which insurance contributions were paid.

To apply for a pension, combatants must provide the following documents:

  • passport;
  • registration number of the taxpayer's account card;
  • employment record book or seniority documents (documents on military service);
  • in case of absence of salary data in the Register of Insured Persons up to December 2016, a salary certificate (financial support);
  • certificate of a combatant;
  • certificates of direct participation of the person in the measures necessary to ensure the defense of Ukraine, protection of the security of the population and the interests of the state in connection with the military aggression of the Russian Federation against Ukraine;
  • photo (for issuance of a pension certificate).

How to calculate the length of service for military pensions

In addition to pensions granted on the basis of length of service, certain periods of service of servicemen are credited on preferential terms: 1 month of service for 3 months.

According to the Regulation approved by Order No. 530 of the Ministry of Defense of Ukraine dated August 14, 2014, certain periods for accrual on preferential terms include

  • participation in hostilities in wartime
  • time of continuous treatment in medical institutions as a result of wounds, contusions, injuries or diseases
  • time spent performing duties as a member of the national contingent and national personnel in accordance with the Law of Ukraine "On Ukraine's Participation in International Peacekeeping Operations"
  • participation in the anti-terrorist operation
  • service in the military reserve during direct participation in the ATO.

What data is used to calculate military pensions?

According to the lawyers of the FLA system, in accordance with paragraph 1-1 of the Resolution of the Cabinet of Ministers of Ukraine No. 393 of July 17, 1992, the length of service for the purpose of granting a pension is calculated on the basis of the service record of the personal file of a serviceman, a person entitled to a pension under the Law of Ukraine "On Pension Provision for Persons Discharged from Military Service and Certain Other Persons" and other documents (extracts from orders, combat reports, combat logs, etc.).
