The Kherson Regional State Administration Lost a Lawsuit Over a Debt Related to the Construction of an Overpass

The court ordered the Infrastructure Department of the Kherson Regional State Administration to pay PJSC "Ukratomenergobud" a debt of more than 4.6 million hryvnias for construction work performed.

This is stated in the ruling of the Commercial Court of the Odesa Region.

The court granted the company’s claim in full. The Department is ordered to pay 3.56 million hryvnias in principal debt, an additional 1.11 million hryvnias in inflation-related losses, and 56,000 hryvnias in court fees. The court issued its full ruling on August 10, 2026.

The dispute concerned a contract dated March 1, 2021, for the construction of an overpass along Admiral Senyavin Avenue and Zalaegerseg Street in Kherson.

According to the company, the total cost of the work performed by “Ukratomenergobud” amounted to over 450.7 million hryvnias. The work covered by certificates Nos. 1–83 was paid for, but the work covered by certificates totaling 3.56 million hryvnias remained unpaid.

The Department contested the lawsuit. In particular, it claimed that the contract had been terminated unilaterally and cited a lack of budgetary funding.

In addition, representatives of the Department questioned the authenticity of the documents related to the performance of the work.

At the same time, the court took into account the conclusion of the construction and technical expert examination dated November 26, 2024.

The expert confirmed that the scope and cost of the work specified in the certificates correspond to the design and cost estimate documentation and the original construction documentation.

The court also noted that it had previously ruled the Department’s unilateral termination of the contract invalid. This decision by the Odesa Regional Commercial Court from March 2024 was upheld by the appellate court in September of that same year.

The decision dated July 30, 2026, may be appealed to the Southwestern Commercial Court of Appeals.
