The court has settled the case regarding the fishermen's huts on the Dniester River

The long-running dispute over a plot of land near the Dniester River in the Odesa region has been resolved by the Supreme Court.

As noted in the court’s ruling, the case concerns more than 2.15 hectares of land at the 47-kilometer mark of the Odesa – Izmail highway, which the Bilhorod-Dnistrovskyi District State Administration leased to the Bilyayivka District Organization of the Ukrainian Society of Hunters and Fishermen for 49 years back in 2004. The plot was provided to house the “Khatky” gamekeeper station.

In 2021, the Odesa Regional Prosecutor’s Office filed a lawsuit seeking to terminate the lease agreement and revoke the right to use the land. The prosecutor’s office claimed that the land was being used for purposes other than those intended, and that summer homes had been built there.

Initially, the courts ruled in favor of the tenant. In April 2024, the Odesa Regional Commercial Court dismissed the prosecutor’s office’s claim. Among other things, the court noted that there was insufficient evidence that the plot was located within a protected area, and that the wooden structures could have been erected legally.

However, in January 2025, the Supreme Court overturned these decisions and remanded the case for a new trial. Following this, the Odesa Regional Commercial Court granted the claim, but the appellate court once again ruled in favor of the tenant.

On August 11, 2026, the Supreme Court reviewed the case for a second time. In its ruling, the court concluded that the location of the vacation homes within the Dniester River’s coastal protection zone violated established restrictions. As a result, the prosecutor’s office’s cassation appeal was granted, and the right to lease the land plot is to be terminated.
