Odesa investigates land deal for road service

In Odesa, law enforcement officers are investigating a possible scheme to illegally obtain more than two hectares of land without holding a mandatory tender. At the center of the case is a company that used a dilapidated building to register a large plot for a future road service.

This is evidenced by the ruling of the Khadzhybeyskyi District Court of Odesa.

The judge allowed investigators to inspect the land plot on Tiraspol Highway as part of criminal proceedings regarding the possible illegal allocation of land to a commercial entity.

According to the investigation, in 2014, a private individual purchased only 93.8 square meters of non-residential premises on the territory of the former property complex. At the same time, more than 2 hectares of land began to appear in the documents, although the new owner had no right to own or use this land.

Later, the premises were transferred to the authorized capital of ART VAY LLC. The investigation believes that the company used this building as a basis for leasing a large plot of land without an auction. It is a territory of 2.1830 hectares.

The court materials state that most of the plot remained free of construction, and the building itself occupied only 0.43% of the territory. In addition, law enforcement officers doubt the suitability of the building for operation, as it is in a ruined state.

Investigators also believe that the company' s officials may have artificially included concrete pavement, fences, and landscaping elements in the property to justify the need to obtain a much larger area of land. According to law enforcement officers, this allowed them to avoid holding land auctions, which are mandatory for such facilities.

The court agreed with the prosecutor's arguments and allowed the inspection of the land plot and the facilities located on it for further examination and recording of evidence.

Also in Odesa region, the head of the legal department of the Tairova village council was suspected of negligence for illegally transferring municipal land worth more than UAH 46 million to a developer. According to the investigation, the land was illegally allocated for residential development without a land auction.
