The Odesa Court of Appeal has canceled the permission of the Bilhorod-Dnistrovsky court for men of military age to cross the border. Earlier, this decision was made by Judge Oleksandr Boyarsky, who is currently under investigation.
This was reported by the Specialized Anti-Corruption Prosecutor's Office.
SAPO prosecutors provided irrefutable evidence that led to the review of the case. On October 31, the Odesa Court of Appeal upheld the SAPO's appeal and overturned the decision of the Bilhorod-Dnistrovskyi City District Court of October 26, 2023, to determine the child's place of residence with his father. These were fictitious divorces with the subsequent deprivation of the mother's right to raise the child in favor of the father. This allowed men to travel abroad.
The SAPO emphasized that it will continue to appeal such decisions, which can be used to evade mobilization and travel abroad.
During 2022-2023, one of the district courts of Odesa region issued more than a thousand permits for men of military age to cross the border. In order to avoid mobilization, the court ruled that the child should live with the father, which allowed the men to leave the country. The cost of such decisions was $1,500-3,000. According to the NABU, the judge of the Bilhorod-Dnistrovskyi City District Court, Oleksandr Boyarskyi, was involved in this.
Earlier, Judge Boyarsky was detained on suspicion of extortion for similar actions and arrested with the possibility of bail.
On January 12, the High Council of Justice granted permission to keep the judge in custody.
In February, the High Council of Justice suspended Oleksandr Boyarskyi, a judge of the Bilhorod-Dnistrovskyi City District Court of Odesa Oblast, from administering justice in connection with criminal proceedings.
