Mykolaiv Court Orders Return of ₴2M Property to State After Invalid Sale

The Mykolaiv court invalidated the sale and purchase agreement due to the buyer's failure to fulfill its obligations and ordered the property to be returned to the state. The prosecutor appealed to the court due to the inaction of the State Property Fund, and the decision has already entered into force.

This was reported by the press service of the Mykolaiv Regional Prosecutor's Office.

The Southwestern Commercial Court of Appeal upheld the prosecutor's claim and ruled in favor of the state, ordering it to return state property worth UAH 2 million.

The sale and purchase agreement for the ventilation billeting workshop concluded between the regional office of the State Property Fund and the entrepreneur was declared invalid.

It turned out that the company had purchased property that was supposed to be dismantled and brought into proper condition for further use of the land plot. However, these conditions were not met. Due to the inaction of the State Property Fund, the prosecutor filed a lawsuit demanding termination of the contract and return of the property to the state.

The decision has already entered into force, and measures are currently being taken to enforce it.

Recently, the Fifth Administrative Court of Appeal upheld the prosecutor's claim and ordered the Vesnianske village council to take over the cultural center with a shelter for 500 people. Due to the absence of a formalized ownership title, the facility was in a state of disrepair, which created risks for local residents.

Earlier, the prosecutor's office found that the Koblevo Village Council had illegally transferred to private ownership a 0.12-hectare land plot in the village of Koblevo, which partially belongs to the state forest fund and the Black Sea beach area. This also became the basis for a lawsuit.

In addition, the head of the district center for administrative services will be tried for land fraud in the resort town of Koblevo - he illegally registered the rights to a land plot on the Black Sea coast for unauthorized persons. For such actions, he faces up to six years in prison.
