Moldova wins dispute over sanatorium in Odesa in court of appeal

The South-Western Commercial Court of Appeal upheld the appeal of the Public Property Agency of the Republic of Moldova and ordered to seize the property of the Moldova sanatorium in Odesa from Maxtgroup Limited Liability Company.

According to the court ruling, the Agency appealed against the decision of the Commercial Court of Odesa Region, which dismissed Moldova's claim in January 2024.

The court reclaimed in favor of the Republic of Moldova, represented by the Public Property Agency of the Republic of Moldova, from Maxtgroup Limited Liability Company the real estate of the Moldova sanatorium, namely

• the non-residential building of the gas boiler house (2-G Posmitnei Street, lit. G-G1, with a total area of 1,37.9 square meters);
• non-residential building of boarding house No. 4 (2-K Posmitnoho Street, lit. B, with a total area of 191.6 square meters);
• non-residential building of boarding house No. 5 (Posmitnoho, 2-B, lit. D, with a total area of 253.4 square meters);
• non-residential building of the swimming pool (2-E, lit. A1, with a total area of 2,338.3 square meters);
• non-residential buildings of the club-dining room (Posmitnoho, 2-Z, lit. A2, A3, with a total area of 2,301.7 square meters);
• non-residential building of the administrative building (2-D, lit. I, with a total area of 731.7 square meters);
• non-residential building of building No. 3 (Posmitnoho, 2-B, lit. D, with a total area of 4,438.8 square meters);
• non-residential building of the main building (2-A, lit. A, with a total area of 3,977.2 square meters);
• non-residential buildings (2 Posmitnoho Street, lit. A4, E-E1, E2, Z, K, L, M, with a total area of 2,421.3 square meters).

The company was also charged UAH 3 million 563.5 thousand in court fees.
