The High Council of Justice has dismissed Serhiy Savytskyi, a judge of the Bilhorod-Dnistrovskyi City District Court of Odesa Oblast, from his post.

According to the HCJ press service, the judge was dismissed on the basis of paragraph 3 of part six of Article 126 of the Constitution of Ukraine.

Paragraph 3 of part six of Article 126 of the Constitution of Ukraine provides that the grounds for dismissal of a judge are committing a significant disciplinary offense, gross or systematic neglect of duties that is incompatible with the status of a judge or has revealed his or her incompatibility with the position.

In turn, the Specialized Anti-Corruption Prosecutor's Office reported that Judge Serhiy Savytskyi was one of the members of an organized group that worked within the judicial system and helped men with military service to illegally travel abroad and receive a deferral from mobilization.

The scheme consisted of massive court rulings on the alleged independent upbringing of a child by a father under contrived circumstances. This allowed men to avoid mobilization and leave the country under the pretext of caring for their children.

For 3.5 thousand US dollars, without the participation of the parties, a decision was made in one court session that gave the right to travel abroad. This judge made 348 unjust decisions, the total number of such decisions is 1.40.

In April, judge Serhiy Savytskyi of the Bilhorod-Dnistrovskyi City District Court of Odesa Oblast was released from custody after posting bail of UAH 1.5 million, and in August, the High Anti-Corruption Court approved a plea agreement concluded with judge Oleksandr Boyarskyi of the Bilhorod-Dnistrovskyi City District Court of Odesa Oblast in the case of a corruption scheme to allow men liable for military service to travel abroad. He was also a defendant in this case.

Oleksandr Boyarsky was found guilty of committing a criminal offense under Part 3 of Article 368 of the Criminal Code of Ukraine "Obtaining undue advantage". He was sentenced to 6 years in prison, but released on probation for 3 years. For this period, he was banned from holding certain positions.

Oleksandr Boyarsky also undertook to transfer UAH 1 million 59.8 thousand, which was paid as bail for him, to the needs of the Ukrainian Defense Forces. In addition, the court confiscated 20 thousand dollars and 200 thousand hryvnias that were in the bank accounts of the accused.
