Judge from Odesa region not to be released due to disciplinary cases

The High Council of Justice has decided to suspend consideration of the dismissal of Oleh Ivinskyi from the position of judge of the Podilskyi City District Court of Odesa Region due to his resignation for the duration of the consideration of the unified disciplinary case.

According to the press service of the High Council of Justice, the judge tendered his resignation on February 2.

However, the Second Disciplinary Chamber of the High Council of Justice, by its decision of November 14, 2025, opened a disciplinary case against the judge on its own initiative and merged it with the disciplinary case opened by its decision of September 3, 2025, on a complaint from the Patrol Police Department against the judge.

In July 2025, the judge had already been brought to disciplinary responsibility and a disciplinary sanction in the form of a reprimand with deprivation of the right to receive additional payments to the judge's salary for one month. The fact is that the HCJ received two disciplinary complaints stating that the judge, based on the results of administrative offenses, released people from administrative liability for drunk driving when the offense was insignificant, despite the fact that this is prohibited by the Code of Criminal Procedure.

The HCJ notes that the judge's explanations suggest that he was well aware of the prohibition, but despite this, the judge applied this rule because he believed that under martial law, deprivation of driving privileges could harm the country's defense capability, especially in the case of mobilized men.

In its turn, the First Disciplinary Chamber of the HCJ noted that the circumstances cited by the judge were not convincing. In January of the same year, DEJURE lawyers sent a complaint against him to the High Council of Justice for the third time. The lawyers stated that in 2023-2024 alone, the judge considered about 40 cases of drunken driving, but contrary to the law, closed them due to the insignificance of the act, limiting himself to an oral remark.
