The Bolhrad City Council successfully sued the company "ATA SERVICE" to recover more than 653,000 hryvnias, as the company had been using a municipally-owned plot of land under its gas station free of charge for a long time. The court ordered the gas station’s owners to pay the debt in full.
This is stated in the decision of the Commercial Court of Odesa Oblast.
The case file indicates that “ATA SERVICE” LLC owns a non-residential gas station building located at 112 Zavodska Street in Bolhrad. The facility is located on a municipal land plot with an area of 0.2436 hectares.
Back in the fall of 2023, the city council adopted a resolution to lease this plot to the company for 49 years and sent draft contracts, but the defendant never signed them. Despite the lack of a formal right of use and failure to pay rent, the company continued to fully operate the gas station.
In court, the defendant’s representatives attempted to contest the claim. They argued that they had not received the documents and that the gas station was allegedly located on a different plot of land. However, the court reviewed the evidence and found the city council’s position to be fully justified.
Under current law, the use of municipal land is subject to a fee, and the absence of a signed agreement does not exempt the party from the obligation to reimburse the funds.
