In Odesa, TCC complies with court decision after threats of fines to its head

The Territorial Center for Recruitment and Social Support in Odesa delayed entering information about the plaintiff's unfitness for military service into the Oberih register for more than a year, following a court decision.

The decision was enforced only after the plaintiff's representative complained to the court about the failure to comply with the court decision and asked to fine the head of the recruitment center UAH 120,000, the maximum possible fine in such a case, the Judicial and Legal Newspaper reported.

In January 2025, the court partially upheld the man's claim, recognizing as unlawful the action of the TCC, which did not enter information about the plaintiff's unfitness for military service in the Oberig register. The decision came into force, but was not enforced for a long time.

In February 2026, the plaintiff's representative requested that the head of the TCC be fined the maximum amount of 40 times the subsistence minimum (about UAH 120 thousand). The court partially granted the application, setting a new deadline for submitting the report, but did not impose a fine, recognizing the request as premature.

In April 2026, the TCC finally submitted the report. The court reviewed the documents and found that the plaintiff had been removed from the military register. The report was accepted, and the court decision was recognized as enforced.

Otherwise, the head of the TCC was still fined UAH 66,560. Half of the UAH 33.3 thousand was transferred to the plaintiff, and the other half went to the budget. The court stated that the TCC had ignored the court's findings that the plaintiff was no longer liable for military service and could not be drafted.

A citizen filed a lawsuit against the TCC with the administrative court, demanding to recognize as unlawful the action regarding the failure to consider his application for exclusion from military registration in the register of conscripts, persons liable for military service and reservists.

The court upheld the claim and recognized the defendant's inaction as unlawful and ordered to consider the plaintiff's application and provide a substantial response based on the court's findings. The decision came into force on July 1, 2025. Subsequently, by a ruling dated October 13, 2025, the court established judicial control over its execution and ordered the TCC to submit a report on the execution of the decision within 30 days from the date of receipt of a copy of the ruling. Instead of submitting the report, the TCC sent the plaintiff a letter demanding that he appear to update the data, ignoring the fact that he had already been deregistered by law.
