In Mykolaiv region, a man occupied a pond and arranged a recreation area

In Mykolaiv region, an indictment against a resident of the Kryvoozerska territorial community of Pervomaiskyi district was sent to court. He will be tried on the fact of unauthorized occupation of a land plot with a pond located within the boundaries of the protected zones (Part 2 of Article 197-1 of the Criminal Code of Ukraine).

This was reported by the prosecutor's office.

According to the investigation, starting from August 16, 2024, a local resident, without any permits from the authorities, illegally occupied a 5.8 hectare land plot belonging to the water fund, namely the coastal protection zone with a pond.

On the seized territory, the offender placed a trailer for living, installed information signs prohibiting fishing and a barrier, and arranged a private recreation area. In this way, he restricted public access to a public water body.

As a result of the unauthorized occupation of the site, the owner of the facility, the Kryvoozerskyi Village Council, was deprived of the opportunity to fully use the land. According to the sanction of the article, this criminal offense is punishable by imprisonment for up to two years.

The Izmail City District Court of Odesa Region approved the agreement between the director of the Kommunalnyk collective enterprise and the prosecutor on the entrepreneur's plea of guilty.

The director was sentenced to five years in prison with a three-year disqualification to hold positions related to waste management at enterprises and institutions of any form of ownership. However, his actual sentence was commuted to a year of probation.

The director of Kommunalnyk was accused of being involved in a scheme organized by an official who, according to the investigation, teamed up with his friend to set up a company that was officially engaged in ship agency services but was actually used for illicit enrichment through improper hazardous waste management, which caused land contamination at the landfill that the company operated.
