Director of a company is released from punishment for embezzlement during the repair of a park in Mykolaiv

A court in Mykolaiv has released from criminal liability the former director of a company accused of embezzling budget funds during the repair of a public garden.

This is evidenced by the ruling of the Zavodskyi District Court of Mykolaiv.

The judge released from criminal liability the former director of Blagoustriy-NK LLC, who was accused of embezzling more than UAH 200,000 of budget funds during the overhaul of the Mykhailo Aleksandrov Park. The reason was the expiration of the statute of limitations.

According to the court, in October 2019, the company and the Department of Housing and Communal Services of Mykolaiv City Council signed a contract for the overhaul of Mykhailo Aleksandrov Park. It is a recreation area between Tsentralnyi Avenue, Buznyk Street, and the territory of the Admiral Makarov National University.

The cost of adjusting the project was UAH 2.7 million, which was later reduced to UAH 1.81 million. In December of the same year, Blahoustriy-NK LLC received full payment for the work.

During the investigation, it turned out that the contractor had indicated in the documents more work than he had actually performed, which led to an overestimation of the cost by UAH 202,780. The director of the company, knowing about the incomplete scope of work performed in the Mykhailo Aleksandrov Park, deliberately signed false acts to misappropriate budget funds.

The case was brought to court in 2021. However, on May 27, 2025, the defendant filed a motion for exemption from liability due to the expiration of the statute of limitations for medium-sized crimes.

Prosecutors objected, citing another criminal proceeding involving this person, but did not provide evidence of proper service of a notice of suspicion or a wanted list in this case.

The court recognized that the statute of limitations had expired under the current legislation, so it decided to close the criminal proceedings due to the impossibility of bringing the accused to justice.

Earlier, the SBU found out that the heads of the Mykolaiv municipal enterprise GDMB acted in collusion with representatives of Promenergosnab and overstated the cost of lamps supplied to the city. Procurements were made through shell companies, which allowed them to raise prices and divert budget funds - in total, the company received more than UAH 70 million.
