Court of Cassation upholds seizure of Mercedes of mother of migration official from Odesa region

The Civil Court of Cassation left without motion the appeal of the lawyers of the mother of Andriy Moraru, Head of the Department of Migration Control, Counteraction to Illegal Migration and Readmission of the Main Department of the State Migration Service in Odesa Region, regarding her Mercedes-Benz G 400 d.

According to the court's ruling, the lawyers were given until May 22 to eliminate the deficiencies of the cassation appeal.

The judges decided that the cassation appeal did not meet the above requirements of the procedural law. In particular, the applicant, in the judges' opinion, referred in general terms to the misapplication of substantive and procedural law by the courts of previous instances, as well as to the legal opinions of the Supreme Court, but did not specify the specific grounds for the cassation appeal, which made it impossible to open cassation proceedings. The applicant also needs to provide information about the planned assessment of the person's daily functioning by expert teams, the extension of the disability period in order to confirm the right to use the court fee benefit.

In March 2025, the Appeals Chamber of the High Anti-Corruption Court upheld the decision to confiscate a Mercedes-Benz G400 D used by Andriy Moraru, head of the migration control department of the State Migration Service in Odesa region.

The official registered the luxury SUV worth UAH 5.65 million in his mother's name in 2023.

However, neither his salary nor his mother's official income allowed for such a purchase. The court found that the car was purchased with funds of unknown origin and ordered it to be transferred to state ownership.

In addition, the NACP, during the audit, found that Andriy Moraru did not declare a 2021 Audi RS Q8 purchased in April 2023 for UAH 500 thousand through the Unicars company associated with scandalous businessman Boris Kaufman. In addition, the declaration does not indicate the 200.5 sq. m. house in Odesa that the official used during the year and the land plot on which it is located.

The official also failed to report his wife's apartment, purchased in 2022 for UAH 1.84 million, as well as his children, who did not officially live with him. Moraru also submitted false information about his salary. In the declaration, he indicated an annual income of UAH 345,116, although according to the state register, his actual salary was UAH 428,715.

In total, the official failed to declare property, assets and income worth more than UAH 83 million. The NACP forwarded the materials to law enforcement agencies under Article 366-2 of the Criminal Code of Ukraine regarding false information.
