Court Cancels Agreement on Fuel Supply for Schools in Mykolaiv Region

The court canceled several contracts for the supply of fuel for schools in the Voznesensk community. The contracts were amended and one hundred thousand hryvnias were overpaid from the local budget.

This was reported by the press service of the Mykolaiv Regional Prosecutor's Office.

The commercial court upheld the claim of the Voznesensk District Prosecutor's Office and invalidated 5 additional agreements to the contract for the supply of gasoline and diesel fuel for schools in the territorial community. The agreement was concluded between the Department of Education, Culture, Tourism, Family, Youth and Sports of the Veselynivka Village Council and a limited liability company.

The prosecutor's office found that based on the concluded agreements, the contract was unreasonably amended to increase the price of fuel, which violates the requirements of Article 41 of the Law of Ukraine on Public Procurement. As a result, almost UAH 100 thousand was overpaid from the local budget.

The prosecutor's office filed a lawsuit in response to the violation of the law. The court decision has now been enforced, and the overpaid funds have been returned to the budget.

In May, the budget of the Chornomorsk village council also received a refund for the fuel they had overpaid for. Thus, the court invalidated additional agreements to the contract for the purchase of gasoline and diesel fuel. Overpaid funds in the amount of over UAH 200 thousand were returned to the local budget.

In March, the court canceled eight agreements on the purchase of natural gas for schools in the Voznesensk district. In 2021, eight additional agreements were signed that unreasonably increased the price of gas and reduced its supply. The Bratske village council will be refunded over UAH 200 thousand that was overpaid from the budget.
