Chernivtsi Prosecutor's Office sues recreation center in Zatoka

The Court of Appeal upheld the claim of prosecutors of the Chernivtsi Specialized Defense Prosecutor's Office of the Western Region and returned the recreation center in the village of Zatoka, Bilhorod-Dnistrovskyi district, Odesa region, to state ownership.

This was reported by the press service of the prosecutor's office.

It was established that more than 1,300 square meters of residential premises worth more than UAH 46 million were illegally transferred from the ownership of the state defense enterprise back in 2013 during an auction and subsequently resold to third parties.

The court agreed with the prosecutors' arguments and recognized the state's ownership of the property. The court decision has entered into force. The process of its execution and registration of the facility in the state register under the Ministry of Defense is underway.

The prosecutor's office did not specify which base it was, but in 2013 the Chernivtsi Specialized Prosecutor's Office reported that it had filed a lawsuit to invalidate the sale of the seized state property of the State Enterprise Chernivtsi Metalworking Plant, the Meteor recreation center. The recreation center is located in Zatoka on Zolotyi Bereg Boulevard. The defendants in the proceedings were the Department of Enforcement of Decisions of the State Executive Service of the Main Department of Justice in Chernivtsi Region and the private enterprise Specialized Enterprise Justice represented by the Chernivtsi branch. The prosecutor's office demanded that the illegally alienated real estate be returned to the state.

The Meteor base, which belonged to the Ministry of Defense, was sold at auction on April 15, 2013. Prosecutors insisted that the auction was held in gross violation of the law and at a low price. The base was sold for UAH 1 million. In 2014, the prosecutor' s office announced that it had won in court, but the base was never returned and the litigation continued. At least the prosecutor's office reported that the base had been returned to the Ministry of Defense several times.
