Case on the death of an infant due to negligence of doctors in Odesa sent to court

Investigators have sent to court the case of three doctors accused of negligence that led to the death of a baby.

This was reported by the press service of the Main Department of the National Police in Odesa Oblast.

The pre-trial investigation found that in August 2022, the acting head of the obstetrics and gynecology department of one of the hospitals in Odesa region and two obstetricians and gynecologists improperly and incompletely examined a patient at 40-41 weeks of pregnancy, found out late that the fetus in the womb lacked oxygen, and performed a cesarean section when the child was already dead.

Police investigators collected the results of a number of forensic examinations, based on which they charged the three defendants with improper performance of their professional duties by medical professionals due to negligence, which caused serious consequences to the minor. This crime is classified under Part 2 of Article 140 of the Criminal Code of Ukraine. The maximum penalty for this crime is imprisonment for up to three years with disqualification to hold certain positions or engage in certain activities for the same period.

Meanwhile, the Kyiv Court of Appeal refused to grant the request of the lawyers of Vitaliy Rusakov, a doctor at Odrex private hospital, to allow him to continue his medical practice. In November, the Kyiv Court of Appeal partially granted the motion of the lawyers of Dr. Vitaliy Rusakov, who is suspected of negligence in the treatment of Odesa businessman Adnan Kivan, which led to the patient's death. The businessman died on October 28, 2024, at the age of 61 as a result of a long-standing cancer. Almost a year later, on October 25, 2025, two doctors at the private Odrex hospital were notified of suspicion of improper performance of their professional duties in connection with his death.
