Antimonopoly Committee finds violations of the law in the rules of advertising in Odesa

The Southern Interregional Territorial Department of the Antimonopoly Committee of Ukraine has given the Odesa City Council two months to correct the rules for outdoor advertising in the city.

According to the department' s press service, the executive committee of the Odesa City Council approved rules, some provisions of which do not comply with the current legislation, namely the standard rules for outdoor advertising, approved by the Cabinet of Ministers of Ukraine in 2003 "On Approval of the Standard Rules for Outdoor Advertising."

According to the AMCU, such actions of the local government may create unfavorable conditions for business activities in the field of outdoor advertising, which may adversely affect the competitiveness of a business entity (distributor of outdoor advertising), negatively affect competition in the market for outdoor advertising services and, as a result, lead to restriction of competition in this market.

In April, the AMC also found that a decision of the executive committee of the Izmail City Council may violate the rules of fair competition in the field of outdoor advertising. In particular, Izmail required more documents than stipulated by the Cabinet of Ministers' Resolution No. 2067 of 2003, which approved the standard rules for outdoor advertising. The city also shortened the validity period of the permit for the installation of advertising structures. If ignored, a case may be opened and sanctions may be imposed.
