The appellate court dismissed the appeal filed by the LLC, which had sought to block the state enforcement officers from forcibly dismantling structures in the Lower Dniester National Park. Law enforcement authorities ruled that the formation of an enforcement team to demolish the company’s structures and return the forest plots to state ownership was lawful.

This is stated in a ruling by the Southwestern Commercial Court of Appeals.

The appellate court emphasized that the formation of the enforcement team is merely an organizational measure to ensure the effective execution of the decision. Since the creation of the team does not alter the scope of the debtor’s obligations, and the remoteness of the structures requires the allocation of additional resources, the company’s complaint was dismissed.

The legal dispute arose after a 2024 lawsuit filed by the Odesa Regional Prosecutor’s Office invalidated the cooperation agreement between the Lower Dniester National Nature Park and Melnichenko LLC. At that time, the court ordered the private firm to completely dismantle its buildings and structures on the protected forest lands and return the land plots to the state.

Due to the large number of structures and their remote location, the Office for the Enforcement of Court Decisions established a special team of state enforcement officers. However, Melnichenko LLC challenged these actions, arguing that the formation of the team was unjustified and violated the company’s rights.
