The hearing on the prosecutor’s office’s lawsuit seeking to invalidate the contract for the major renovation of the stadium at Odesa Secondary School No. 40 was postponed due to the failure of the parties to appear. The hearing was rescheduled for November 3, 2026.
This is stated in a ruling by the Commercial Court of Odesa Oblast.
The legal dispute concerns a construction contract signed in 2017 between the Capital Construction Department of the Odessa City Council and ODESAKOMUNEKOLOGIYA LLC. According to the Peresypsk District Prosecutor’s Office, anti-competitive collusive actions on the part of the contractor took place during the procurement process, which led to a distortion of the tender results.
As part of the case, the prosecutor’s office is seeking to have the contract declared invalid and to recover 8,152,000 hryvnias from the company for work performed. The Southern Interregional Territorial Branch of the Antimonopoly Committee of Ukraine has been brought in as a third party on the plaintiff’s side.
The proceedings in this case have been repeatedly suspended pending legal opinions from the Grand Chamber of the Supreme Court on similar disputes, as well as postponed due to a change in the presiding judge, the declaration of air raid alerts, and the failure of the parties to appear. After the conclusion of the preliminary proceedings, the court was to proceed to the merits of the case; however, due to the absence of all participants, the hearing had to be postponed once again.
