A restaurant and fitness center in a pseudo-hotel on the coast are put up for sale in Odesa

Private Joint Stock Company "Holding Company "Kyivmiskbud" has put up for sale a restaurant and fitness center in a building at 77-A Fontanska Road.

According to the Center for Public Investigations, the relevant announcements were published in the Prozorro.Sale system.

The starting price of the restaurant with an area of 2.60 square meters is UAH 82.4 million, and the fitness center with a total area of 1,339.1 square meters is UAH 56 million 242.2 thousand.

In 2020, the Shevchenkivskyi Court of Kyiv granted investigators of the SBU Chief Investigator's Office temporary access to seize electronic copies of all documents entered by registrars into the State Register of Real Property Rights, the Register of Real Property Ownership, the State Register of Mortgages, and the Unified Register of Prohibitions on Alienation of Real Property during the initial registration of real property in Odesa at 77a Perekopska Divizii Street.

This was done as part of a criminal investigation into abuse of power. The investigation found that in 2006, Odesa City Council granted permission to design and build a 120-bed hotel with a sports and recreation and cultural and entertainment complex at 13 Velykyi Fontan station. For this purpose, Kometa-M LLC leased a 1.35-hectare plot.

As stated in the urban planning conditions and restrictions, the site is located in the Black Sea protection zone, in the recreational and resort development zone. The architectural and planning assignment sets restrictions on the number of storeys of buildings up to 8 floors.

At the request of Kometa-M, a project was developed that provided for the construction of three seven-story hotel buildings with 70 apartments and 113 parking spaces, with a total area of 17,611 square meters.

In 2008 and 2010, the SACC Inspectorate in Odesa region issued permits for construction work. The construction customer was Kometa-M LLC, and the general contractor was Jaguar LLC.

However, according to the investigation, the officials of Kometa-M LLC, knowing about the existing restrictions on the use of the site, entered into a criminal conspiracy with Jaguar LLC and PrJSC HC Kyivmiskbud to build three residential buildings with eight and nine floors with a total area of 33,944.2 square meters, including an underground parking lot for 130 cars, instead of the duly approved hotel of three seven-story buildings with 70 apartments and 113 cars, with a total area of 17,611 square meters.

During the pre-trial investigation, law enforcement officers found that all three buildings were located 60 meters from the Black Sea water's edge, i.e. within the 100-meter coastal protection zone. In addition, according to the General Plan of Odesa, approved in 2025, the said site is located in green areas of public use (Yubileiny Park). Kometa-M LLC has been liquidated since October 2019. Litigation over the buildings at 77-A Fontanska Road continued last year.
